Welcome to Kitchen of Planty, my catering business. My name is Larissa, and I am an independent chef and caterer based in Amsterdam, registered with the Chamber of Commerce under number 55793649 and VAT number NL17866.50.22.B01. The following terms and conditions govern all services, products, and activities provided by Kitchen of Planty.
1 DEFINITIONS
In these terms and conditions, the following terms shall have the meanings outlined below:
1.1 Client: An individual or business that uses the services or products offered by Kitchen of Planty, or participates in any of the events organized by Kitchen of Planty.
1.2 Services: All tasks and offerings outlined in an agreement to be provided by Kitchen of Planty to the client.
1.3 Products: All items created by Kitchen of Planty that are purchased by the client.
1.4 Activities: Any events organized by Kitchen of Planty that involve client participation.
1.5 Agreement: A written or verbal mutual commitment in which Kitchen of Planty agrees to provide a service or product in exchange for payment from the client.
2. QUOTES
2.1 All quotes provided by Kitchen of Planty are non-binding.
2.2 Clients cannot claim any rights based on the quotes, and Kitchen of Planty reserves the right to amend them as needed, in consultation with the client.
2.3 Quotes typically do not include travel expenses or VAT.
2.4 An agreement is considered binding once both parties have confirmed it, either verbally or in writing.
3 PAYMENT & INVOICES
3.1 The invoice must be paid within 14 days from the date it is issued.
3.2 If the client fails to make payment on time, additional administrative fees, interest, and collection costs may be charged.
3.3 Payments should be made to account number NL75 KNAB 0776 1325 12, in the name of L. Quaak, referencing the invoice number.
3.4 For invoices above €2000 (excluding VAT), a 50% deposit may be required, with adjustments made on the final invoice if necessary.
4 CANCELLATION POLICY
4.1 Cancellation is free of charge up to 30 days before the agreed delivery of the service/product, unless otherwise specified.
4.2 If cancelled up to 10 days before delivery, the client must pay 20% of the agreed amount.
4.3 If cancelled up to 3 days before delivery, 40% of the agreed amount is due.
4.4 Cancellation within 3 days of delivery will result in a 75% charge of the agreed amount.
4.5 All cancellations must be confirmed in writing by Kitchen of Planty.
4.6 The client may reduce the number of participants at no charge up to 7 working days before delivery. Reductions within 3 to 0 days of delivery are treated as cancellations, and Article 4.4 applies.
4.7 Any increase in the number of participants must be discussed and approved by Kitchen of Planty before final confirmation.
5 EXECUTION
5.1 The client is responsible for ensuring that Kitchen of Planty has access to the necessary facilities (such as gas, water, electricity, and space) at the venue in a timely manner, free of charge, unless otherwise agreed.
5.2 The client or recipient of the meal has one hour from the delivery or pick-up time to guarantee the quality of the food.
6 LIABILITY & DAMAGES
6.1 Kitchen of Planty cannot be held liable for any damages to the client or individual, except in cases of intentional misconduct, gross negligence, or fault on the part of Kitchen of Planty. This includes damage arising from the consumption of food prepared or served by Kitchen of Planty.
6.2 Any complaints must be reported to Kitchen of Planty within 2 hours of delivery for immediate evaluation.
6.3 In cases of force majeure, Kitchen of Planty is not liable for any damages or complaints.
6.4 If Kitchen of Planty is unable to fulfill an order for reasons other than force majeure, they will make reasonable efforts to offer a suitable alternative.
